(1) If any person related to the crime is found or is in the act of committing the crime, the police or investigation officer can arrest him.
(2) If a person needs to be arrested immediately in accordance with this paragraph in connection with the investigation of a crime, an application must be made to the officer handling the case for permission to issue an arrest warrant along with the details of the identity of the person to be arrested as far as possible.
(3) If an application is received in accordance with sub-section (2) and if the reason for arrest is found to be reasonable, the officer hearing the case may grant permission to issue an arrest warrant on the same application.
(4) The format of the arrest warrant will be as mentioned in Schedule-8.
(5) The order under subsection (3) shall not be made public until the person to be arrested is arrested.
(6) Notwithstanding anything written in sub-section (2), if the person committing the offense is not arrested immediately, if such person escapes or destroys evidence, evidence or evidence, such person shall be arrested immediately by issuing an arrest warrant in accordance with schedule-9. For approval, the arrested person along with the case should be submitted to the officer.
(7) If a person has been arrested by issuing an arrest warrant as per sub-section (6), no other investigative action related to such offense shall be taken without obtaining approval from the investigating officer. However, if there is a possibility that the evidence related to the crime will be destroyed, lost or destroyed, the body of the arrested person, the things used by him, the vehicle, the house or the place where he is staying can be searched immediately. If the search is taken in this way, the details of the search, the search warrant and the seizure bond must be attached and submitted to the officer who will look into the case.
(8) If the police are not immediately available when an offense is committed, the person who was present at the time of the offense or who witnessed the offense shall report the offender to the nearest police station without allowing him to escape.will be able to explain.
(9) If a person is arrested in accordance with sub-section (1) or (6), before the arrest, the reason for the arrest must be disclosed and an order to surrender must be given.
(10) Even when reminded, explained or given an order in accordance with sub-section (9), if any person tries to avoid arrest or escape or escape without surrender, or if he commits or tries to do any kind of coercion with or without the use of force, the police personnel shall use necessary force to arrest him. (11) If a woman has to be arrested according to this section, she should be arrested as much as possible by the women police. However, if a female police officer is not immediately available in the event of an arrest, the male police personnel shall not prevent the arrest by respecting the physical sensitivity of the woman so as not to harm her honor or reputation.
(12) Food search or body search of a person caught under this section may be conducted.
(13) If there is reasonable cause to suspect that the person to be arrested in accordance with this section is residing in a house or place, such house or place may be searched and arrested.
(14) If a person is arrested while conducting a search according to sub-section (13), the body of that person can also be searched.
(15) According to sub-section (12) or (13), the document related to the evidence or the evidence or any other item found during the search shall be taken into possession by the person or the investigating officer who arrests such person and shall pay compensation for the same.
(16) Notwithstanding anything contained in sub-sections (1) and (2), if any person commits any offense under Schedule-1 or Schedule-2 in the presence of any police officer or officer or in any government office, the concerned police officer, officer or head of office shall Without allowing him to escape, he should be arrested and handed over to the relevant police office or investigation officer.
(17) According to sub-section (8) and (16) the concerned police or investigation officer shall issue the necessary arrest warrant to the person who has been arrested and brought in accordance with sub-section (6).The case should be submitted before the officer.
